MINUTES OF ANNUAL MEETING (September 2005)

On September 28, 2005 the Drayton Place Home Owners Association held its annual meeting. Present at the meeting were the following board members, officers, and/or directors: Dave Tagliaferri, Sandra Tagliaferri, Sandy Taylor, Barbara McNeal, and Stephanie Theis. With quorum present and duly noted, the meeting was called to order by DPHOA President Dave Taligferia at approximately 7:30.

 

The first order of business was to discuss with Association members the actions that had been taken since the last special meeting to correct covenant violations. Mr. Tagliaferri discussed the actions taken by the recently formed “Violation Committee” to confirm, identify, and hopefully, correct covenant violations. He reported that the “Violation Committee” had sent out through the Associations attorney in excess of 20 notices of violation allowing members opportunity to correct violations and/or request a hearing, and if necessary, be fined.  The notices covered various violations from shed, boats, trailers, lawn maintenance, trash, debris, etc.

 

Although the majority of members expressed support for theses actions by loudly clapping, two members (one being suspended the previous month for non payment of association dues) voiced their continuing and vociferous opposition to any actions being taken against property owners having illegal boats and sheds, and  demanded, inter alia, (1) the names of all members on the Violation Committee; (2) the date, location and times of any such meetings of the Violation Committee; (2) the Association’s “volunteer” attorney be terminated due to conflict of interest and other attorney be engaged; (3) the Association not enforce the covenants, over look the violations, disregard member complaints, or try for third time to amend the covenants.

 

Mr. Tagliaferri duly noted these concerns and generally responded: (1) the names of Violation Committee members would not be disclosed at that time for fear of reprisal but may be obtained during any hearing that was requested or by proper written request to the Association; (2) any meetings of the Violation Committee do not have to be noticed, if they in fact, had already had a meeting; (3) the Associations attorney had no conflict of interest, had fully disclosed his residency in the community, and the Association would and/or did waive any such conflict if it existed; (4) the Association must enforce the covenants, could not overlook the covenants, could not amend the covenants inconsistent with the law, and must respond to valid member complaints or face liability. Mr. Taligferri, and other officers and directors, particularly said that sheds were a direct violation of the covenants and absolutely forbidden from being on the property regardless of location, design, or whether screened from view, and that sub standard lawn maintenance would no longer be tolerated. Yet, the opposition by the two members persisted, and was again noted.

 

The next order of business was the continuing discussion of the neighborhood watch program and the appointment of block captains. At the present time, various block captains were appointed.   The date of the community garage sale (September 28, 2005) was also discussed as well as the need, and estimated price, to purchase neighborhood signs.

 

As for the final matter, the Association held its annual election for members of the Board. Directors. The members so nominated and elected were Jim Littleton, Dave Tagliaferri, Sandra Tagliaferri, Sandy Taylor, and Louis Mansour. The Associations attorney, Daniel A. Nicholas, was nominated, but he withdrew his name from consideration and reaffirmed his abstention from such matters.   Thereafter,  the Board Members agreed to elect amongst themselves the officers and directors and post all referenced officers (and members) on the website at dpkchoa@com/index.htmc   

 

Thereafter the meeting was adjourned.
