This emergency BOD meeting was called to
order at the Southeast Public Library by President Sandy Taylor
with Treasurer Barbara Costifas and Director Denise Nicholas in
attendance as well as several residents. Ms. Taylor then stated
that she was going to read the following into the record:
Good evening. My name is Sandy Taylor and I am the President
of the
Drayton Place Home Owners Association. We are making official
recording of this meeting on behalf of the HOA. To avoid
disruption,
we are asking all other persons wanting to record to stand at
the back of the room so not to interfere, but let it be known
that Shaun Miller has refused after being asked continually to
oblige.
I want to personally thank each director and officer who are
here
tonight and have volunteered their time to serve their
community.
Sadly, many residents, including some in attendance, do not
appreciate
that you are volunteers. You have jobs, families, many other
commitments, but still make the time to volunteer and serve the
community. I personally thank you. Having been a director for
several
years, I can honestly say that as a board, the current HOA has
done
more and volunteered more time for this community than any
other.
As I said at the last meeting, there is a serious increase in
crime in
the neighborhood, some of which, very pathetically, has been
directed
to you as directors and officers. You have experienced slashed
tires,
keying of cars, obscene phone calls, assault, stalking, thrown
rocks,
attacks on your children, vandalism, violence, allegations of
stealing, improprieties, threats of violence, and I could go on.
Many
of these incidents have been perpetrated by some of the
very persons
in attendance that would rather “get even” then volunteer.
For instance, there is Bill Davis who resides at 12207 Mantle
Drive.
For nearly 10 years he has “angrily” refused to comply with
covenants
and pay dues. As a community, we were forced to endure his
dilapidated
fence, illegal shed, illegal boat, all surrounded by his
diseased and
bug infested lawn. It was not until the current DPHOA sued Mr.
Davis
in 2006 that these conditions were corrected as part of a court
approved stipulation. In revenge, Mr. Davis has responded with
focused
range against directors and our agents.
Then there is Shaun Miller who resides at 4113 Ripken Circle
East. Mr.
Miller was upset when our attorney requested he stop using his
front
driveway as a storage lot for his 20 foot boat. Rather than
simply
remove the boat as required by covenants, Mr. Miller, and his
wife,
Ann Silverness, driven by revenge, engaged in a campaign to
libel the
directors and our agents in flyer and misleading survey. Ms.
Silverness even filed bar grievance against our volunteer
counsel who
has volunteered hundreds of hours of time to help the community
and
its residents—free of charge. Mr. Miller and Ms. Silverness, who
have
done nothing to help this community, requested disbarment.
We have been informed that Mr. Miller and Ms. Silverness tried
to get
our counsel fired from his law firm. I am pleased to inform the
directors that the Florida Bar dismissed Ms. Silverness’
grievance as
meritless, and as all of you have known for several months, our
counsel had long ago accepted a new position at one of
Florida’s
largest and most prestigious law firms. The point being that Mr.
Miller and Ms. Silverness would rather personally attack
directors or
our lawyer out of revenge than volunteer to help the community.
Then there is Nancy Coursey who resides at 12227 Ruth Lawn
Court. For
the three years I have been a director, and I have seen first
hand
her endless barrage of letters and rants personally attacking
this
and past board members—our volunteers. Most recently, in revenge
for
the HOA only speaking to her attorney, she has been harassing
our
directors by sending total “40” emails within a two day period,
most
successive e-mails being within minutes of the previous. Again,
again,
and again, like a game, Ms. Cousey e-mails, and attacks If
added to
all other e-mails she has sent, and past letters, many of which
the
HOA had to pay monies for third parties, agents , and attorneys
to
respond, her total communications, most acidic and nasty in
tone,
would approximate 125 personal attacks.
Then, of course, is past president David Tagliaferri and
Treasurer
Sandra Tagliaferri, who have engaged in a malicious campaign to
destroy the very association they were once believed to be
serving,
all the time concealing their past actions, which now comprise
lawsuit
the DPHOA has filed against them for breach of fiduciary duty
and to
recover missing monies. We will gladly provide copies of the
lawsuit
to any that request so you can see first hand the allegations
of
mismanagement and missing monies.
Indeed, after the lawsuit was served, Mr. Tagliaferri directly
contacted current director Beverley Bonner to force and obtain
her
resignation. Using trick, intimidation, and manipulation, Mr.
Tagliaferri called Ms. Bonner under guise of HOA position to
force her
resignation. This was the very same pattern of trick,
intimidation,
and manipulation previously used by Shaun Miller against Ms.
Bonner
when he tried to force her resignation. After receiving the
latest
call from Mr. Tagliaferri, and in light of the current
atmosphere of
harassments and intimidation being fostered by Mr. Tagliaferri
and
others, sadly, I must inform the Board that Ms. Bonner has
tendered
her resignation to be effective on February 1, 2007.
In accepting her resignation, I want to personally thank Ms.
Bonner
for her time and efforts in helping the community and apologize
to her
for the behavior of certain residents that necessitated her
resignation. I also want to personally thank each of you for
“putting
up” with this offensive behavior as we work together as
volunteers to
help our community.
With this being said, I come to the emergency purpose of this
meeting. We as directors need to appoint a successor director to
serve
the balance of Ms. Bonner’s term. We are at a cross road for
this
community in terms of the next step we must to take to
effectively
manage and operate the community and reduce crime. As we
discussed at
the last meeting, there are several pending matters for which
the
input of another director would be of vital importance,
particularly,
as we consider direct engagement of police to reduce crime, a
management company to insulate the board from harassing
behavior, the
seeming inevitability of a dues increase, and the continuity of
legal
action
Then Ms. Taylor requested Board discussion on any matters
deem necessary, and motion to name successive director.
Denise Nicholas nominated Danny Kaelin, approved by Barbara
Costifas & Sandy Taylor, and formally named Dan as a new
director. Ms. Taylor then nominated Denise Nicholas as
Secretary.
Mrs. Nicholas then went on to say that the attacks on her
children were absolutely going to stop and completely
unacceptable. No one volunteering and giving of themselves
should have to be harassed, threatened, or targeted by a few
nasty individuals and Mrs. Costifas and Mrs. Nicholas both
agreed to support whatever means necessary to stop the violence
aimed at the BOD even the hiring of a management company.
Meeting was then adjourned
